据IAR6月22日报道，6月21日，一家德国的香料和食品加工剂制造商（Hela Schwarze GmbH）根据中德双边投资条约在ICSID提起投资仲裁请求。
海乐（Hela）公司自1996年开始在济南市经营，与当地一家肉类加工公司合资，1999年转为德国所有。原告由德国柏林的一家律所Wagner Arbitration所代理。
本案是目前已知第三起外国投资者诉中国投资仲裁案件。预计ICSID官网很快会发布案件登记信息。
据网上资料，德国海乐中国分公司（济南海乐西亚泽食品有限公司）位于山东济南市历城区，主要服务范围是化工产品; 天然香辛料; 脱水蔬菜; 天然香辛料; 出口脱水蔬菜。所属行业分类为蜜饯业，企业类型为外资企业。
中国曾于1983年与德国签署双边投资协定，2003年12月1日中德双方重新签署新的BIT，新协定于2005年11月11日生效。根据新协定第十六条有关过渡期的规定，一九八三年十月七日签订的《中华人民共和国和德意志联邦共和国关于促进和相互保护投资的协定》将在本协定生效后终止；本协定应适用于缔约一方的投资者在缔约另一方的境内的所有投资，不管其是在本协定生效之前还是之后作出的。但是，本协定不得适用于在本协议生效前已进入司法或仲裁程序的与投资有关的任何争议或请求权。此等争议和请求应继续按本条第一款规定的一九八三年十月七日的协定的规定解决。

German investor lodges BIT claim against China
A new claim has been brought against the People’s Republic of China
The claim was registered by ICSID on June 21, 2017, and is brought under the China-Germany BIT.
The claimant is German-owned spice and food additive manufacturer, Hela Schwarze GmbH. Hela has been operating in the city of Jinan since 1996, as a joint-venture with a local meat processing company, and was transferred to German ownership in 1999.
The claimant is represented by Wagner Arbitration. We have reached out to the claimant’s counsel and will update this story if we learn more.
This case is the third ICSID claim brought by foreign investors against China. As we recently reported, last March an ICSID tribunal concluded that the claims of Korean investor Ansung Housing Co. Ltd. were time-barred under the Korea-China BIT.
